A1. Business Ratings Seal Members Terms

The following terms apply to all SAFE-b Business Ratings Seal Members, which includes anyone who has an active account subscription to SAFE-b for Business Ratings.

Many of our terms are found throughout our website on the pages where they need to be known and understood. However, as a general overview, we will restate on this page the rules which are strictly enforced.

A2. General Business Member Rules and Terms:

You agree not to post any reviews of your own business.
You agree not to generate any "fake" transactions, as a means of increasing your rating.
You agree not to use your rating as an incentive for others to generate transactions on your behalf, for the primary or partial purpose of raising your rating.
You agree not to make any attempt to "restart" your rating, in the event that your rating is low, by starting new accounts related to the same or similiar business
You agree not to make any attempt to "transfer" your rating to another business, trade your rating, sell your rating, buy a rating, or merge your rating in a business merge, without written approval from SAFE-b.
You agree not to make any attempt to divert negative reviews from your customers to any alternate website.
Your seal may not be displayed in any way where buyers could easily confuse your seal and rating to apply to other sellers or businesses that you do not control.
If you resize your seal image, it must not be stretched significantly out of standard proportion.
SAFE-b reserves the right to reject or limit any account for any reason at our sole discretion.

A3. General User Rules and Terms

The following are some basic rules that apply to all non-business users and reviewers visiting SAFE-b.

You agree not to post any reviews of any business that you have not made a transaction with.
You agree to use the transaction number that the business provided to you, and you acknowledge that without this transaction number your rating will not be displayed.
You agree not to tamper with any web beacon in any attempt to create fake transactions
You agree not to create any transactions with any business for the primary or partial purpose of writing a review or rating for that business.

1.0h Offenses and our Authority
We reserve the right to terminate, suspend, or limit any account on SAFE-b for any reason at our sole discretion. We may terminate accounts for violation of these terms, and such termination may have no option for recourse. In accordance with our privacy policy, we reserve the right to track and monitor account and user activity on the SAFE-b website, and activity related to our third-party payments processor, and use this information to block potentially fraudulent activity, or activity that is in violation of these terms.

1.0i NO WARRANTIES
SAFE-B.COM AND ALL CONTAINED SERVICES ARE PROVIDED ON AN "AS IS" BASIS. WE PROVIDE NO WARRANTIES OR REPRESENTATIONS, EXPRESSED OR IMPLIED, AS TO THE VALUE, GOODNESS, USABILITY, TITLE, AND NON-INFRINGEMENT; THAT THE WEBSITE WILL ACCOMPLISH WHAT YOU NEED OR WANT IT TO, WILL BE ALWAYS AVAILABLE OR TIMELY, SECURE, SAFE, WHOLESOME, ERROR-FREE, APPROPRIATE, OR OTHERWISE MEET EXPECTATIONS; THAT SELLERS ON SAFE-B.COM WILL BE HONEST, TRUSTWORTHY, MEET EXPECTATIONS, SHIP ON TIME, OR PERFORM AS PROMISED; THAT ITEMS BEING SOLD ON SAFE-B.COM WILL BE LEGAL, AVAILABLE AT TIME OF SALE, OR MEET EXPECTATIONS; ANY IMPLIED WARRANTY THAT PRESENTS ITSELF DURING THE PROCESS OF TRANSACTIONS OR USE; ANY LIABILITY ARISING FROM NEGLIGENCE ON THE PART OF SAFE-B OR ITS EMPLOYEES OR ASSOCIATES, TO THE FULL EXTENT PERMISSIBLE UNDER APPLICABLE LAW, SAFE-B SHALL NOT BE HELD LIABLE AND DOES NOT OFFER ANY WARRANTY.

1.0j GENERAL RELEASE
SAFE-B.COM IS NOT AND SHALL NOT BE INVOLVED IN ANY DISPUTE BETWEEN BUYER AND SELLER. YOU AGREE THAT YOU WILL NOT HOLD SAFE-B.COM, ITS EMPLOYEES OR ASSOCIATES LIABLE IN CONNECTION WITH ANY DISPUTE, CLAIM, OR CHARGEBACK ARISING FROM ANY TRANSACTION, OR FOR ANY DAMAGES, NO MATTER WHAT IS THE NATURE, CAUSE, EFFECT, SCOPE, CONSEQUENCE OR INVOLVED PARTIES OF SUCH DAMAGES THAT RESULT FROM ANY DISPUTE.

1.0k Indemnity / Limitation of Liability
YOU WILL DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS SAFE-B, ITS EMPLOYEES AND ASSOCIATES AND OWNERS, AGAINST AND FROM ALL DAMAGES, JUDGMENTS, FINES, EXPENSES (INCLUDING ATTORNEYS' FEES), RESULTING FROM ANY ACTUAL OR BELIEVED BREACH OF YOUR PORTION OF ANY AGREEMENT, OR OUR PORTION OF ANY AGREEMENT. OR ANY INFRINGEMENT OF RIGHTS, OR ANY FAILURE TO PAY OR COLLECT TAX. SAFE-B SHALL NOT BE HELD LIABLE FOR DAMAGES OF ANY SORT, WHETHER DIRECT OR INDIRECT, IN CONNECTION WITH ANY SERVICE OR AGREEMENT PRESENTED ON THE SAFE-B.COM WEBSITE, OR ASSOCIATED SITES, OR ANY MESSAGES, PRODUCTS, SALES, OR ACTIVITIES PERFORMED ON OR THROUGH SAFE-B.COM OR ANY ASSOCIATED SITES.

1.0l Laws
The laws of the state of Texas shall govern this agreement in its entirety, without providing consequence to any statues of conflicts of laws or the Convention on Contracts for the International Sale of Goods. Any judicial sentences for claims or disputes related to this agreement shall be settled in Harris County, Texas and you waive any right to selection of location of any court or jurisdiction.

1.0m Disputes
SAFE-b.com is not the representative or agent of any user for any reason, and as such, we will not assist in any dispute resolution process. However we do encourage buyers and sellers to resolve disputes between themselves and work towards creating a safe and effective marketplace environment.

1.0n Grant of Rights
Any content you submit to SAFE-b, whether media or text or any other form of content, shall grant to us the full, worldwide, everlasting, un-cancelable, royalty-free right and license to display, use, copy, change, and exploit in any manner. With the limitation that we will not change or remove any trademark, except in cases where any automated process we implement should remove or alter portions of your submitted content which we did not know was removal or altering of trademarks, or in cases where we were not made and verified to be aware of trademarks present, or in cases where we do not allowed trademarked content to be submitted. Without limit to our right to use without any consent any and all content under fair use under copyright law, referential use under trademark law, or valid license from a third party. By submitting content of any sort, you expressly state and warrant that you own or control all rights to said content, and that we will not infringe upon any rights of any of your rights or the rights of any third parties.

1.0o Termination
We, SAFE-b.com, have the right to ban, suspend, restrict and limit access or services in any way to anyone for any reason at any time and at our sole discretion.

1.0p General Provisions
This agreement includes and incorporates all other agreements and conditions of this website, including the privacy policy, and together forms the entire agreement, and overrules and cancels any prior agreements, understandings, claims, in regards to the matter in subject. SAFE-b.com is not the agent or representatives or security or trustee or fiduciary of any user of this website. No part of this agreement may be used directly or indirectly to the advantage of any outside party to gain any legal right or privilege or claim or remedy in regards to anything that appertains to SAFE-b.com or its services or users. This entire agreement is for the benefit of SAFE-b.com, and its users. Any portion of this agreement that is not legally enforceable shall not in any way reduce the enforceability of any other portion. No part of this agreement shall be considered waived by us except in writing and signed by SAFE-b.com.

2.0 General Rules

The following General Rules set forth some broad or basic rules which all users of this website must adhere to.

2.0b Misuse of Ratings
Businesses on SAFE-b.com may not do any thing or make any effort to redirect bad ratings to an alternate website. Any attempt to lie about past performance or cause bad performance to appear or to be displayed as good performance on this site will constitute fraud or deception and will result in suspension of membership privileges or legal action being taken. Sellers shall make every effort to ensure that every reason for any and all order cancellations or refunds or returns are reported, if asked to be reported, in a way that is the most accurate representation of the reason for cancellation. Sellers may not shift the blame for other cancellations to the buyer, or to another third party, if in fact they themselves are responsible for the failure. Likewise sellers may not cause themselves to appear more satisfactory than they are, by posting or presenting any content or image of themselves which would give buyers an understanding or implication that they offer better performance or better guarantees than what the seller is willing or able to deliver.

2.0c Excessive Use
Users of SAFE-b.com shall not cause an undue burden on the website by excessively using any feature, service, or portion of the site for themselves. No excessive automatic indexing or bulk automated operations may be performed on the website.

2.0d One business per account
There is a limit of one person or organization per business account. Multiple personal users, or multiple businesses, or any multiple combination thereof, may not user the same business account. Members shall be fully responsible for all activities done on or through their account.

2.0e No multiple accounts
No member on SAFE-b.com may possess multiple accounts at any time for the same business.

2.0f Honesty in account information / identity
All business members shall submit only valid and truthful account information, and shall represent themselves and their identity on this website truthfully.

2.0g No return for banned users
Users who have been suspended or banned shall not return to SAFE-b.com under a different user name.

2.0h Businesses banned from other websites may not migrate to SAFE-b
Businesses who have been banned from other websites for bad seller performance on those websites may not come and create Businesses accounts on SAFE-b.com to bring their poor performance here.

2.0i Leave Feedback
We ask that buyers leave accurate and truthful feedback when feedback, rating, or commentary options exist.

2.0j Must be 18 years old
All Business members on SAFE-b.com must be 18 years or older. We do not, nor can we monitor the age of any user, and it is therefore the full responsibility of each user to abide by this policy.

3.0 Businesses Performance Policies

In order to maintain a safe and effective marketplace environment for buyers, we strongly enforce seller performance standards standards.

3.0b Harming SAFE-b and other Sellers
No member or user on SAFE-b.com may do any thing that we, at our sole discretion, deem to be harmful to the SAFE-b.com website, reputation, users, or functionality.

4.0 Listing Policies

Business members and users are required to abide by the following listing policies.

Users may not post any links or HTML or other active web content or script into any comment, description, feedback, or other text submission.

4.0d Key word spamming
Users may not post excessive words into any submission for the purpose or apparent purpose of targeting search engine or user search queries.

5.0 Item Description Policies

The following item description policies set forth some rules relating to item descriptions and other forms of communication on the SAFE-b.com website.

5.0b Profanity
Users may not post profanity or corrupt communication in any item description, comment, feedback, message, or content submission on SAFE-b.com.

5.0d Rights of Publicity
Certain celebrities or names may have the right to their own image or name, and you may not use those images or names or representations to endorse or promote your products or services without their consent. It is your sole responsibility to obtain permission for any and all use of trademarks, registered trademarks, and any use of any thing that another else may claim rights of publicity to.

8.0b Business Ratings Seal Limiations
Posting and sharing of Business Ratings Seal images and links must in done in a mannor that is honest, safe, and harmless to all recipients of such links. Users may not use or create viruses, trojans, malware, adware, or any other stealth program to promote their website or business where Business Ratings Seal images or links are found. Users may not share SAFE-b.com Business Ratings Seal images or links in a mannor that defames, slanders, or otherwise harms or supports or participates with those who harm SAFE-b.com by any of these means. Users may not use bulk email spamming or unsolicited email spamming to promote their Business Ratings Seal images or links. Users may not send or cause to be sent any emails containing Business Ratings Seal images or links to users who did not opt-in to receive such emails, or to email addresses hosted on large third-party "bulk email list" websites or services, even if these bulk email companies claims that all users opted-in, as often times these opt-in processes involved sneaky agreements hidden in privacy policies, to which the user did not intend to agree to. users may not promote their affiliate links in any way that would suggest that they are representatives of SAFE-b.com, its employees, or associates.

9.0 Copyright Policies

The following guidelines concern our policy in handling complaints and inquiries regarding copyright ownership or infringement on SAFE-b.com

9.0a How we handle when we receive copyright complaints
It is our goal to work with and offer assistance to with all requests and concerns regarding copyrights and infringements on SAFE-b.com. Depending on the volume or complexity of such requests, we may be unable to resolve all issues in a timely mannor. We may require full identity and proof of rights to any content that is claimed, and once verified we will do our best to resolve any issues.
